An article I wrote for Thomson Reuters' monthly Estate Planning magazine, expanding an argument I was developing in Jack Straw volume one, number three, in connection with the Craig Trust case out of New Hampshire, to the effect that section 112 of the uniform trust code, which extends the rules of construction for a decedent's will to the interpretation of a revocable trust functioning as a "will substitute," is at odds with the theory under which the revocable trust found acceptance at common law.
