Update 05 July 2018

The above entry was posted in early 2016.  Just today, Thursday, July 05, 2018, more than two years later, we have an answer from the Arizona state attorney general, and he says both the 1998 amendment to the state statute, abrogating the rule against perpetuities altogether as to a trust if the trustee has a power of sale, and the 2008 amendment extending the "wait and see" period to five hundred years "likely violate" section 29 of article 2 of the state constitution, which forbids legislation "permitting any perpetuity or entailment."

Many thanks to state Sen. Olivia Cajero Bedford for making this happen.  The next step is to repeal these two amendents.
